Returns and cancellation
An original work of art is a single object, so this policy is written for that. It covers cancelling before dispatch, returning a work after delivery, damage in transit and refunds. It does not limit any right you have under the Consumer Protection Act, 2019 or the law of your own country.
Cancelling an order
You can cancel an order at any time before it is dispatched. Write to the gallery with your order number. A cancelled order is refunded within 7 working days of the cancellation.
Once a work has been dispatched, the order cannot be cancelled, but you may be able to return it. See the next section.
The gallery may cancel an order if a work has already been sold elsewhere, or if its price or details were shown in error. If that happens, you are told straight away and refunded in full.
Returning a work
A return must be requested within 30 days of delivery.
A work can be returned if:
- it is in the condition in which it was delivered, with no hanging hardware, framing or alteration added;
- it goes back in its original packing, or packing that protects it as well; and
- the certificate of authenticity and the invoice come back with it.
Commissioned works cannot be returned. Every other work — including framed works and books — can be returned on the same terms.
How to return a work
- Write to the gallery with your order number and the reason for the return, before you send anything.
- The gallery confirms the return. Send the work back to the gallery's address — Ground Floor, 34/1G Ballygunge Circular Road, Kolkata 700019, West Bengal, India — in its original packing.
- When the work arrives in Kolkata, the gallery checks it against the condition it left in and tells you whether the return is accepted.
Who pays for return shipping
You pay for return shipping, and it is not refunded — except where the work arrived damaged. See Damage in transit.
Damage in transit
If a work arrives damaged:
- Keep all the packing.
- Photograph the outer packaging, the packing inside and the damage before you unpack further.
- Tell the gallery within 48 hours of delivery, with the photographs and your order number.
The gallery pays to bring the work back, and pays for whichever outcome you choose: a full refund, or — where the gallery can offer it — the work restored and sent again, or a replacement copy for a print edition or a book still in stock. The gallery claims on its courier's insurance; you never have to.
Refunds
- When: within 7 working days — from the cancellation for a cancelled order, or from the returned work reaching the gallery for a return.
- How: to the original method of payment. An order paid by Cash on Delivery is refunded to a bank account you give the gallery.
- What: the price of the work and the GST charged on it. Delivery was free, so there is no shipping charge to refund.
Your bank may take further days to show a refund in your account.
Offers
An offer is a conversation, not a contract, so there is nothing to cancel until the gallery accepts it. You may withdraw an offer at any time before the gallery replies. If the gallery accepts your offer it reserves the work for you for 72 hours and emails you a payment link good for exactly that period. Letting those 72 hours pass is not a cancellation and costs you nothing: the reservation simply lifts, the link and the agreed price stop working, and the work returns to the gallery at its listed price. Once you place an order through that link the sale proceeds like any other, and the cancellation terms above apply to it in the same way.
