Terms of sale and use

These terms apply when you use this website or buy from it. They are written in plain English so that a buyer in India, or anywhere else, can understand them before buying. Please read them together with Shipping, Returns and cancellation and the privacy policy, which form part of them.

1. Who we are

The website is operated by Bizarre Mart Private Limited, a company registered in India, trading as Artshoppy ("the gallery", "we", "us").

  • Registered office: Ground Floor, 34/1G Ballygunge Circular Road, Kolkata 700019, West Bengal, India
  • Contact: support@artshoppy.com or +91 99039 71710.
  • Grievance officer: Jishu Bhowmik, +91 99039 71710, support@artshoppy.com. Complaints are acknowledged within 48 hours and resolved within one month.

2. Using the website

You may browse the website and buy from it for your own purposes. You must not:

  • copy, download in bulk or republish photographs of works, which belong to the artists or their estates;
  • use the site in a way that breaks the law, interferes with its operation, or tries to get around its security;
  • give false information when you order, enquire or open an account.

If you open an account, keep your password to yourself. You are responsible for orders placed with it.

3. The works

  • Descriptions. The gallery describes each work, including its artist, medium, dimensions and year where known, as accurately as it can. Colours on screen differ from the work itself, and a photograph can never show texture fully. Ask for more photographs before you buy if a detail matters to you.
  • Originals. Unless a page says the work is a print or an edition, it is an original, and there is one of it.
  • Certificate. Every original is issued with a certificate of authenticity by the gallery.
  • Framing. Frames shown in On the Wall are a preview. A work is supplied unframed unless its page says otherwise, or unless you have agreed framing with the gallery in writing.
  • On the Wall. The room views show a work at scale using its recorded dimensions. They are a guide to size, not a photograph of the work in that room.

4. Prices and tax

  • Prices are in Indian rupees (₹) and exclude GST.
  • For delivery in India, GST is added at checkout: 5 % on works of art and 0 % on books, at the rates in force on the day of the order.
  • For a delivery outside India, arranged as described in Shipping, no Indian GST is charged. Import duties, taxes and customs charges in the destination country are payable by the buyer on delivery (delivered duty unpaid).
  • Shipping charges are shown or quoted before you pay.
  • If a price is shown in error, the gallery will tell you before dispatch, and you may either pay the correct price or cancel with a full refund.
  • A work marked Price on request is priced by the gallery in writing on enquiry.

5. Making a contract

  • Checkout. Placing an order is an offer to buy. The contract is made when the gallery confirms the order by email.
  • By enquiry. When a price is agreed through an enquiry on WhatsApp or email, including a work marked Price on request, the gallery creates the order for the buyer and sends the order confirmation by email. The buyer pays on delivery (Cash on Delivery, cash only, for now). The same order confirmation rule applies to these orders as to a checkout order.
  • One of each. Because an original exists once, if the same work is ordered twice at the same moment, the first confirmed order stands and the other is cancelled and refunded in full.
  • Offers. Make an offer lets you propose a price for a work that allows it, from 70 % of the asking price; the gallery does not accept an offer below that floor. An offer is a conversation, not a contract — it commits neither side, and the gallery may accept, counter or decline any offer without giving a reason. If the gallery accepts your offer it reserves the work for you for 72 hours and emails you a payment link good for exactly that period; while the reservation holds, nobody else can buy the work. If the 72 hours pass without an order, the reservation lifts, the link and the agreed price stop working, and the work returns to the gallery at its listed price. A reservation is a hold, not a contract: the contract is still made only when the gallery confirms your order by email.

6. Payment

  • At present the only payment method at checkout is Cash on Delivery, for Indian delivery addresses. The gallery currently delivers within India only.
  • A buyer abroad enquires with the gallery instead of checking out: the gallery raises the order and quotes delivery together with it. International shipments travel delivered duty unpaid (DDU), so the buyer pays their own country's import duty, VAT, GST or sales tax on arrival; if a charge is refused and the shipment returns to Kolkata, the buyer pays the return freight. Refunds are made in Indian rupees.
  • Ownership of a work passes to you when the gallery has received payment in full. Risk in a work passes to you on delivery.

7. Delivery, export and National Art Treasures

Delivery is covered in Shipping. Works declared National Art Treasures under the Antiquities and Art Treasures Act, 1972 cannot be exported. You agree not to buy such a work for delivery outside India, or to remove it from India. Where a work needs export documents, the gallery prepares them; you are responsible for your country's import rules.

8. Cancellation, returns and damage

Covered in Returns and cancellation. Nothing in these terms limits your rights under the Consumer Protection Act, 2019, or the mandatory consumer law of the country where you live.

Buying a work gives you ownership of the physical object. Copyright stays with the artist or their estate. You may photograph your work for your own records, for insurance and to resell it, but you may not reproduce it for sale without the copyright holder's permission.

10. Enquiries and messages

When you write to the gallery through Ask about this work, WhatsApp or email, the gallery uses what you send to answer you, as set out in the privacy policy. WhatsApp is a service of a separate company, and its own terms apply to messages sent through it.

11. Our liability

  • The gallery is responsible for loss or damage it causes that was foreseeable when the contract was made.
  • The gallery's liability for a work is limited to the price paid for it, except where the law does not allow such a limit, such as for death or personal injury caused by negligence, or for fraud.
  • The gallery is not responsible for a delay or failure caused by events outside its reasonable control, such as natural disasters, epidemics, strikes, government action, customs holds or carrier failures. It will tell you and agree a new date, or refund you if you prefer.

12. Changes to these terms

The gallery may update these terms. The version that applies to an order is the one published on the day the order was placed. This version is effective from 13 September 2026.

13. Law and disputes

These terms are governed by the laws of India, and the courts at Kolkata, West Bengal have jurisdiction. If you are a consumer living outside India, you may also have the protection of the mandatory law of your country.

Before going to court, please write to the gallery's grievance officer, named in section 1, so that we can try to put things right.
